NC Board of PT Examiners Report at the NCPTA Business Meeting

1. Purpose of the Board:  Reminder of the purpose of the Board is to regulate the practice of physical therapy in order to protect the health, safety, and welfare of the citizens of North Carolina.   The next meeting of NC Board of PT Examiners is scheduled for Wednesday, December 6, 2006.

2. Appointments to the Board:  The 2006 appointments (PT and PTA) have been made by Governor Easley.  They are as follows:  Stuart W. MacRoberts, PT, and JoDell F. King, PTA. 

The 2007 Ballots for appointment of one physical therapist and one physical therapist assistant were mailed in early August with a return deadline of September 15, 2006.  The ballots were counted at the NCPTA Headquarters on September 26, 2006. 

Beginning in 2007 and in response to requests from licensees for additional information about nominees who are potential appointees by the Governor, the Board will send a request for basic biographical information to each nominee who has consented to serve and post it on the Board’s web page when the ballots are mailed.  The biographical form is fairly simple and straightforward to keep the playing field level.   (See attachment)

3. Proposed Changes to Board’s Rules: The Board is proposing several changes to the current Board’s rules including: 1) a clarification regarding test scores for the TOEL (Test of Foreign Language), 2) documentation requirements, 3) increase in licensure fees, and 4) other clarifications and editorial changes as recommended by the staff of the Rules Review Commission.  Information regarding the proposed rules changes is available on the Board’s web page. (www.ncptboard.org).  The tentative effective date for the  rules is November 1, 2006.

4. Continuing Competence:  In response to the passage of the continuing competence legislation by the North Carolina General Assembly in July, 2006, at its Board Meeting on September 19, 2006, the Board passed a motion to appoint a 6-member Advisory Panel for Continuing Competence.  The Advisory Panel to the Board will consist of 3 Board members, 2 members of the NCPTA, and 1 non-member of the NCPTA.  The Panel will be assisted by John Silverstein, Board Attorney, and Ben Massey, Executive Director.   The purpose of this panel will be to study the various options available for Continuing Competence and make recommendations to the Board.  The Advisory Panel will not have authority to adopt rules as this is the responsibility of the Board.

The Board directed Ben Massey to contact the NCPTA President to ask the Chapter to recommend 5 or 6 Chapter Members for the Board to consider for appointments with a requested deadline of November 1, 2006.

The Board also approved sponsoring nine (9) statewide forums on continuing competence in 2007 in the following cities: 

A. Ahoskie or Elizabeth City
B. Asheville
C. Boone
D. Charlotte
E. Fayetteville
F. Greensboro (in conjunction with the NCPTA Fall Meeting)
G. Greenville
H. Hickory
I. Raleigh (in conjunction with the NCPTA Spring Meeting)

(The forums will be conducted by John Silverstein and Ben Massey.  There will be no registration fee for the Forums.  Massey will tape record / summarize discussion for the Panel and the Board.)

The Board adopted the following tentative timetable:

A. Appointment of the Advisory Panel at the Dec. 6, 2006 Board Meeting.
B. Sponsoring of statewide forums in 2007.
C. Interim Report from the Advisory Panel to the Board in Dec. 2007.
D. Final report from the Advisory Panel to the Board in Mar. 2008 with recommendations for changes in the Board’s rules.
E. Following the March 2008 Board meeting, staff to begin the “Rules Process” with effective date of Feb. 1, 2009.
F. Upon adoption of the Board’s rules (probably in the 3rd quarter of 2008), staff will begin an education program for licensees.

5. Chemical Dependency Program:  The Board is in negotiation with the North Carolina Board of Nursing (BON) for the BON to provide contract services for a chemical dependency program for physical therapy licensees as an alternative to disciplinary action.

6. Continuing Education Programs:  In response to requests by members of the NCPTA at the 2004 Spring Conference, on May 2, 2006, the Board presented an educational program, “Mock” Informal Meeting of the Investigative Committee, at Southeastern Lifestyle Center for Fitness and Rehabilitation in Lumberton, NC.  This presentation was co-hosted by Southern Regional AHEC.  Unfortunately programs scheduled in Durham and Charlotte were cancelled due to low registration.  Programs are scheduled in Winston-Salem on November 28, 2006 and in Hickory on December 12, 2006.  Information can be located at our web page (www.ncptboard.org).

7. Jurisprudence Exercise:  To ensure that new licensees are familiar with the North Carolina Physical Therapy Practice Act, Board’s rules, and position statements, all applicants who apply for licensure after January 1, 2007 will be required to complete an online jurisprudence exercise.   Current licensees may also complete the jurisprudence exercise and will receive a certificate for 1 contact hour.

9. Board Newsletter: The next Newsletter should arrive in late December / early January. Please read your Newsletter, discuss it at staff meetings, and file it for future reference.

10. Changes of Address: As there is a rule that requires notification of the Board of address and name changes within 30 days, as a friendly reminder, please keep the Board apprised of current home and work addresses, phone numbers, fax numbers, and email addresses.  License renewals will be mailed the first of November.  There will be no increase in renewal fees this year.
